Terms of Service

Participation in any West Coast Martial Arts program is voluntary and requires:

• Completion of all required enrollment forms and waivers
• Compliance with academy rules, policies, and instructor guidance
• Physical and mental capability to participate safely

Minors must have consent from a parent or legal guardian.

We reserve the right to deny or terminate participation at any time for safety, conduct, or policy violations.

Martial arts training involves inherent risks, including but not limited to physical injury, contact with others, falls, strains, or unforeseen accidents.

By participating, you acknowledge and accept all inherent risks and agree that West Coast Martial Arts, its owners, instructors, staff, and affiliates are not liable for injuries or damages except where prohibited by law.

Participants are responsible for consulting a physician before beginning any training program.

• Membership fees, program pricing, and payment terms are disclosed at enrollment
• Payments are non-refundable unless explicitly stated otherwise in writing
• Missed classes do not constitute grounds for refunds or credits
• West Coast Martial Arts may update pricing or program structures with reasonable notice
• Failure to maintain payment may result in suspension or termination of access

All members, students, guests, and parents are expected to:

• Treat instructors, staff, and fellow students with respect
• Follow safety rules and class instructions
• Maintain proper hygiene and attire
• Avoid disruptive, aggressive, or inappropriate behavior

Violation of conduct standards may result in disciplinary action, suspension, or termination without refund.

Participants agree to:

• Disclose relevant medical conditions that may impact training
• Refrain from training while injured, sick, or impaired
• Follow instructor guidance regarding safety and technique

West Coast Martial Arts reserves the right to restrict participation for safety reasons.

All content, including logos, branding, curriculum, videos, written materials, website content, and training methods, are the intellectual property of West Coast Martial Arts or its licensors.

You may not copy, reproduce, distribute, or exploit any materials without prior written consent.

By participating in classes or events, you grant West Coast Martial Arts permission to capture and use photos, videos, and recordings for promotional, educational, and marketing purposes unless you submit a written opt-out request.

8.1 Consent to Receive Messages

By submitting your phone number, email address, or contact information through our website, forms, chat systems, or in-person enrollment, you expressly consent to receive communications from West Coast Martial Arts, including:

• Class schedules and updates
• Enrollment and billing notices
• Trial confirmations and reminders
• Program-related announcements
• Customer service communications

Messages may be delivered via SMS (text message), MMS, phone call, email, or automated systems.

8.2 A2P Messaging Compliance

West Coast Martial Arts complies with A2P 10DLC messaging requirements, including:

• Messages are sent only to users who have opted in
• Message content is related to our services and programs
• No sale or sharing of mobile numbers
• No misleading, deceptive, or prohibited content

8.3 Message Frequency and Fees

Message frequency may vary. Standard message and data rates may apply depending on your mobile carrier.

Opting out does not affect essential service-related communications required for membership administration where permitted by law.

8.5 Mobile Information Privacy

No mobile information will be shared with third parties or affiliates for marketing or promotional purposes. Information sharing to subcontractors in support services, such as customer service, is permitted.

All other use case categories exclude text messaging originator opt-in data and consent; this information will not be shared with any third parties.

8.6 Carrier Liability Disclaimer

Mobile carriers are not liable for delayed or undelivered messages. West Coast Martial Arts is not responsible for service interruptions, message delivery failures, or technical issues related to mobile carrier networks.

8.7 Age Restrictions

Users must be at least 18 years old to opt into SMS communications. By opting in, you confirm that you meet this age requirement.

If you are under 18, parental or guardian consent is required where legally permitted.

We may use third-party tools for scheduling, payments, CRM systems, and communications. West Coast Martial Arts is not responsible for the policies or practices of third-party providers.

Use of third-party platforms is subject to their respective terms and privacy policies.

You agree not to:

• Attempt to gain unauthorized access to systems or data
• Use the website for unlawful purposes
• Disrupt website functionality or security

We may suspend or restrict access for violations.

All services are provided "as is" and "as available."

West Coast Martial Arts makes no guarantees regarding outcomes, skill advancement, fitness results, or personal development.

To the fullest extent permitted by Nevada law, West Coast Martial Arts shall not be liable for indirect, incidental, consequential, or punitive damages arising from participation, use of services, or communications.

You agree to indemnify and hold harmless West Coast Martial Arts from claims, damages, or liabilities arising from your participation, conduct, or violation of these Terms.

We reserve the right to terminate or suspend access to services or communications at our discretion, with or without notice, for policy violations or safety concerns.

These Terms are governed by and construed under the laws of the State of Nevada, without regard to conflict of law principles.

West Coast Martial Arts may update these Terms at any time. Updated versions will be posted on our website with a revised effective date.

Continued use of services constitutes acceptance of the revised Terms.
